When we will provide our services. We will begin providing you with our services, being the property valuation using our property e-valuation tool, when you submit the details of a property to our property e-valuation tool via our website, provide your contact details and accept these terms and conditions by ticking the “I agree to the Terms & Conditions” box. After submitting these details, our property e-valuation tool should provide you with a property valuation based on the details you entered. At this point we will have finished providing you with our services and the contract will be ended.
Free service for consumers. We only supply our property e-valuation tool for your private use or by an agent as part of the services it delivers to you. As you are a consumer, our property e-valuation tool is currently provided on a free to use basis and no payment is due from you.
Making sure the details you provide are accurate. However, as our property e-valuation tool provides you with the requested valuation for a property almost immediately after you submit the property details and agree to these terms and conditions, the contract between us for the provision to you of our services ends almost immediately after it has been entered into. This means there is not time for you to exercise your rights to cancel this contract.
Nevertheless, we are under a legal duty to supply services in conformity with these terms and conditions and nothing in these terms will affect your legal rights.
We may not make our property e-valuation tool available to you in the future if you breach this agreement our or our website’s terms of use.
4. Our responsibility for loss or damage suffered by you
We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms and conditions, we are responsible for loss or damage you suffer which is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage which is not foreseeable. Loss or damage is foreseeable if either it is obvious it will happen or if, at the time the contract was made, both we and you knew it might happen.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to our property e-valuation tool including the right to receive services which are as described and match information we provided to you about our property e-valuation tool and supplied with reasonable skill and care.
We are not liable for business losses. We only supply our property e-valuation tool for domestic and private use. 5. Other important terms
(a) Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
(b) If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides any of them are unlawful, the remaining paragraphs will remain in full force and effect.
(c) Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean you do not have to do those things and it will not prevent us taking steps against you at a later date.
(d) Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of our property e-valuation tool in the English courts. If you live in Scotland you can bring legal proceedings in respect of our property e-valuation tool in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of our property e-valuation tool in either the Northern Irish or the English courts.
(e) The Property Ombudsman’s alternative dispute resolution service. Alternative dispute resolution is a process where an independent body, such as The Property Ombudsman considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to contact The Property Ombudsman. You can submit a complaint to The Property Ombudsman via their website at www.tpos.co.uk. The Property Ombudsman will not charge you for making a complaint and if you are not satisfied with the outcome you can still bring legal proceedings. Diss and Harleston Property Market Holding Up Despite Doom and Gloom in the Newspapers
The Diss and Harleston housing market over the last three months is now becoming more ‘normal’ after the last couple of years of insane demand when the lockdowns started a race for space!
Even with the blackening economic doom-mongers forecasting a harsh slowdown in the British property market, the number of people buying and selling their homes is still very good for the time of year.
Whilst many homeowners are reducing their asking prices, it is not the 20% (some even said 30%) drop some property commentators and newspaper journalists had predicted.
Looking at the stats for Diss and Harleston for the last three months since the disastrous Truss mini budget – they make good reading.
Of the 57 Diss and Harleston properties that have sold (stc) since late September, the average length of time it took to achieve a sale was 94 days.
Interesting when you split it down by price, in Diss and Harleston:
·Under £100k – 35 days
·£100k to £200k – 212 days
·£200k to £300k – 81 days
·£300k to £400k – 181 days
·£400k to £500k – 156 days
·£500k to £1m – 93 days
·£1m and above – no properties sold in this price range
And by type:
·Diss and Harleston Apartment/Flat – 183 days
·Diss and Harleston Terraced/Townhouse – 95 days
·Diss and Harleston Semi-Detached – 76 days
·Diss and Harleston Detached – 141 days
The latest sold price data from the Land Registry shows that Diss and Harleston house pricescurrently remain 12.5% higher than they were 12 months ago; the rate of growth has dropped significantly.
Last month, Diss and Harleston house prices only rose by 0.8%; thus, we are seeing the first sign that the property market is starting to cool.
With interest rates at 3.5% and further increases likely in 2023, that will undoubtedly spur ongoing cooling in Diss and Harleston property values yet it’s doubtful we will see the Diss and Harleston property market go into the deep freeze that many doom-mongers were predicting.
As I said in recent articles on the Diss and Harleston property market, we will see a 5% to 10% reduction in Diss and Harleston house prices over the next 12 to 18 months.
That will only take us back to the prices achieved in mid/late 2021 or early 2022 (depending on the property type).
Landlords have experienced double-digit rent growth in the last 12/18 months with a shortage of rental properties coming onto the market. I cannot see this changing in the short term, so I expect rents to be a further 10% higher by Christmas 2023.
Last week I stated it is not always wise to only focus on house prices but also take reference from the number of property transactions completed that feed the fire of the British property market.
For example, in March 2021, 135,670 properties sold, yet a month later, it dropped to 87,600. A couple of months later, it rose again in June 2021 to 165,290 homes sold (for it to drop to 64,000 in July).
Whilst this is good news for estate agents and removals companies, it can skew the property market and put undue pressure on the property market (pressure which could cause a housing crash if not put under check).
Like most things - slow, steady and consistent is the preferred option for the property market. Throughout 2022, the number of properties selling in the UK has been a steady average of 68,832 per month, ranging from a low of 61,800 in January 2022 to 72,200 in July 2022.
This consistency will continue into 2023 and a return to a more 'normal' housing market.
One final thing I have noticed about the Diss and Harleston property market in the last six months is the number of larger properties coming onto the market that last sold over 25 years ago.
Homeowners in their 20s, 30s and early 40s tend to move every five or six years, yet when they reach their late 40s and 50s, they tend to stay put for longer. These properties only tend to come on the market when people pass away or must be sold for nursing home fees.
These mature homeowners are downsizing for several reasons. Their children have flown the nest and they’re rattling around in homes with accommodation they don’t need. Many are being driven to sell their large homes in light of mounting energy bills, high inflation and never-ending maintenance costs that larger properties demand.
The second reason is that the recent rises in Diss and Harleston house prices has meant the money released to downsize has grown, meaning if these mature homeowners sell up and cash in to more manageable properties, the amount of money released is quite impressive.
In conclusion, 2023 is going to be a more 'normal' year, akin to the 2016 to 2019 years. Diss and Harleston homeowners need to be realistic with their pricing, yet as over eight out of ten sellers buy another home, the one you buy will be lower.
